ACLU Comment on Biden Migration Protection Protocols Action

WASHINGTON — The Biden administration will today begin allowing some of the thousands of asylum seekers languishing in Mexico under the Trump-era Migration Protection Protocols program to pursue their asylum cases in the United States.

The American Civil Liberties Union and partners had challenged the Trump administration policy when it was first implemented.

Judy Rabinovitz, ACLU attorney and lead counsel in the case, said of this latest development:

“This Trump-era policy has been a humanitarian disaster, depriving thousands of asylum seekers of a meaningful opportunity to obtain asylum, while forcing them to endure perilous conditions in Mexico where they have been targets of kidnapping, rape, and other abuse.

“The Biden administration’s action is a welcome start toward ending this inhumanity, but it must move swiftly to remedy the life-threatening situation facing everyone affected by this policy. That means allowing them to pursue their cases in the United States, in safety and without further trauma, detention, or delay.”
